Non-Compliance of a number of National Anti-Doping Organizations (NADOs) 2018-02-02

NON-COMPLIANCE OF A NUMBER OF NATIONAL ANTI-DOPING ORGANIZATIONS (NADOS)

Dear Colleagues,

On 16 November 2017, the World Anti-Doping Agency’s (WADA) Foundation Board declared the following signatories non-compliant with the World Anti-Doping Code (Code) with immediate effect (please see the press release).

Equatorial Guinea – National Olympic Committee of Equatorial Guinea (acting as NADO)
Kuwait – Kuwait Anti-Doping Committee
Mauritius - Anti-Doping Unit, Ministry of Youth and Sports, Mauritius

Accordingly, WADA wishes to provide all National Anti-Doping Organizations (NADOs) and interested Public Authorities with an overview as to the consequences of this non-compliance for your own anti-doping programs. These consequences were determined by the independent Compliance Review Committee (CRC) and approved by WADA’s Foundation Board.

Testing of International-Level Athletes

The non-compliant NADOs are not permitted to conduct any testing in their countries whilst they are deemed non-compliant. As a result, all Anti-Doping Organizations (ADOs) that are using any of these NADOs for out-of-competition testing are kindly requested to reallocate the conduct of such testing to private sample collection organizations, or foreign NADO personnel. This practice should continue until these NADOs are no longer deemed non-compliant.

Collection of Whereabouts

The non-compliant NADOs will continue to be responsible for the administration of their Registered Testing Pool (RTP) as applicable, including the induction of athletes into the pool, management of Anti-Doping Administration & Management System (ADAMS) accounts, and the sharing of whereabouts information with International Federations (IFs) where the athlete is also in the International RTP and other NADOs if the athlete is in a second national RTP, as applicable.

Results Management

Regarding national-level cases that are currently pending, the non-compliant NADOs will continue to conduct results management under strict WADA monitoring.

Therapeutic Use Exemptions (TUE)

The non-compliant NADOs will not be in a position to analyze TUE requests. Any non-compliant NADOs that receive a TUE request from a National-Level Athlete, shall forward such request to the applicable IF.

ADAMS Access

The non-compliant NADOs will maintain access to ADAMS during their non-compliant period in order to carry out the tasks that they are able to continue fulfilling and facilitate ongoing monitoring by WADA.

WADA is working actively with the relevant signatories to address the specific situations of non-compliance and to ensure that anti-doping activities can be conducted within the countries during the period of non-compliance.
